Do I need to charge sales tax?

In some locations, it is required for Tophatter to withhold sales tax from orders.

Tophatter will retain the sales tax that was charged to the buyer, and remit to the appropriate entity at the end of the year. There are no charges or fees to sellers for Tophatter automatically calculating, collecting, and remitting sales tax in these locations listed below.

Alabama Alaska Arizona
Arkansas California Colorado
Connecticut District of Columbia Florida
Georgia Hawaii Idaho
Illinois Indiana Iowa
Kansas Kentucky Louisiana
Maine Maryland Massachusetts
Michigan Minnesota Mississippi
Missouri Nebraska Nevada
New Jersey New Mexico New York
North Carolina North Dakota Ohio
Oklahoma Pennsylvania Puerto Rico
Rhode Island South Carolina South Dakota
Tennessee Texas Utah
Vermont Virginia Washington
West Virginia Wisconsin Wyoming

For all other locations, it is the seller's responsibility to determine whether they need to charge sales tax.

Sellers are also responsible for reporting and remitting the sales tax collected to the appropriate taxing authority.

Sales tax rules are complicated, and vary by jurisdiction and type of goods sold. We recommend that you speak with a qualified tax adviser if you have any questions regarding your requirement to collect and remit sales tax, and consider potential sales tax implications before deciding to sell on Tophatter.

As a result of legislation in the UK effective January 1, 2021, all sales to UK consumers are subject import VAT. Bids shown to consumers are inclusive of VAT. Bid amount, Shipping & Handling, and VAT will be reflected as separate lines on your invoice, paid through the Tophatter platform.

The VAT collected is paid to UK HMRC, and is based on the hammer or buy now price.
